Terms of service
What we provide
We sell one plan. It is called Presence. We write a jingle that sings your company's name. We make a fifteen-second video ad with it. We run that ad on YouTube to people within about 15 miles of your business. Each month we send you a short report. Presence is $500 a month, month to month, with no contract. Details of the plan may change. If a change reduces what you get, we tell active clients by email at least 30 days before it takes effect.
What we need from you
At checkout you give us your town, your trade, and one or two services you want the ad to feature. That is all. After you pay there is no call, no questionnaire and no recording session. We never need access to any of your accounts, including your Google Business Profile.
We send you the ad before it airs. You may reply to change anything in it. If you do not reply, it airs.
Ownership
On payment of your first month, or of the jingle fee, we assign to you all rights we hold in the jingle. The jingle is yours to keep, even if you cancel. Music made with the help of AI tools may not qualify for copyright protection under current US law. We do not promise that no one can ever copy it. Our promise to you is in the next section.
One seat per trade, per town
We take one company per trade per town. The first checkout takes the seat. While you are an active client we will not take on another business in your trade in the town you give us at checkout. If you cancel, the seat opens after your final paid month ends. A second town is its own seat at $500 a month. This seat is our only exclusivity commitment. It gives no trademark rights.
Ad spend
The ad spend is inside your $500. It is about $150 a month and never more than $200. The ad runs on our Google Ads account and is paid with our card. You open no account and pay no second bill.
Platform rules
We follow Google's and YouTube's advertising policies. We will not run an ad that breaks them, and we may end service if you ask us to.
Price and payment
Presence is $500 a month. Your price holds for as long as you keep the seat without a lapse in payment. Fees are billed in advance each month through Stripe. Failed payments pause service after seven days. Prices are in US dollars and exclude any taxes that apply. Refund and cancellation terms are on the refunds page and form part of these terms.
Your monthly report
Your report comes from our Google Ads report for your ad. It shows full watches, how many separate people that was, how often the average person saw the ad, and what each full watch cost.
The guarantee
On air within 10 days of payment. 1,500 full watches in your first 90 days on air. Miss either and every dollar comes back, automatically.
A full watch is one completed view. That means someone watched the whole fifteen-second ad, as counted in our Google Ads report. Under Google's definition, a click on the ad also counts as a view.
If we miss either promise, we refund every monthly fee you paid for your first 90 days on air, up to $1,500. You do not need to claim it. If the ad is not on air by day 10 after payment, we pay the refund within 7 days after day 10. If the ad falls short of 1,500 full watches, we pay the refund within 7 days after day 90 on air.
The guarantee does not apply if you cancel before day 90, or if you dispute a charge. Days the ad is paused at your request are added to the 90 days. You keep the jingle either way.
Results
The guarantee covers the two promises above and nothing else. It does not promise calls, enquiries, jobs, or any position in Google search. Memory of a name builds over months. Results, if any, usually take 6 to 12 months.
Jingle credit
A client who buys the $2,000 jingle and starts Presence within ninety days of delivery has the full $2,000 credited against the first months of Presence.
Confidentiality
We keep your business information private and use it only to serve you. You agree not to share our internal methods, pricing offers or reports with competitors.
Limits on liability
Our total liability to you for anything arising from these terms is limited to the fees you paid us in the three months before the claim. We are not liable for lost profits or indirect losses, or for the acts of third-party platforms such as Google and YouTube. Nothing here limits liability that cannot be limited by law.
Ending service
You can cancel at any time. Reply to any email from us, or use the Stripe customer portal link in your receipt. The ad stops at the end of the month you paid for. The jingle stays yours. We may end service at once if you ask us to break a platform rule or a law, or if payment fails and is not fixed within 14 days. We do not pause or end service because you are out of touch.
Law and disputes
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before either of us files a claim we agree to talk it through in good faith for 30 days. Any claim not resolved that way goes to the state or federal courts in Delaware, or to small-claims court where you are, at the claimant's choice.
